Terms of Use

These terms also serve as CaptionAddr's End User License Agreement (EULA).

These Terms of Use ("Terms") are a legal agreement between you and Dynsell LLC ("Dynsell," "we," "us," or "our") for your use of the CaptionAddr mobile application, website, and related services (collectively, "CaptionAddr" or the "App"). By downloading, installing, accessing, or using CaptionAddr, you agree to these Terms. If you do not agree, do not use CaptionAddr.

1. Eligibility and Acceptance

You must be at least 13 years old, or the minimum age required in your jurisdiction, to use CaptionAddr. If you use CaptionAddr on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. What CaptionAddr Does

CaptionAddr is an iOS and iPadOS app for importing video clips, transcribing speech locally on device using a bundled Whisper Small model, editing caption text and timing, styling caption overlays, and exporting a finished captioned movie file. CaptionAddr does not upload your source video or audio to perform transcription.

3. License

Subject to these Terms and the Apple Media Services Terms and Conditions, Dynsell grants you a limited, personal, non-exclusive, non-transferable, revocable license to use CaptionAddr on Apple-branded devices that you own or control, as permitted by Apple's App Store usage rules.

CaptionAddr is licensed, not sold. We and our licensors reserve all rights not expressly granted in these Terms.

4. Accounts and Entitlements

CaptionAddr does not require a named user account for core use. The app may use anonymous Firebase authentication, StoreKit transaction information, and an app account token to verify subscription entitlements and restore access where supported.

5. CaptionAddr Pro

5.1 Product

CaptionAddr Pro is offered as an auto-renewable monthly subscription through Apple's In-App Purchase system. The current configured product is CaptionAddr Pro Monthly with product ID Pro_Monthly.

5.2 Free and Pro Limits

All users can use local transcription, caption editing, caption styling, and burned-in captioned movie export within the applicable video length limit.

5.3 Price and Trial

The US storefront price configured in the local StoreKit configuration is $6.99 per month. App Store prices can vary by country, region, taxes, currency, and Apple pricing rules. The final price, billing period, and eligibility for any introductory offer are shown by Apple before you confirm purchase.

Eligible new subscribers may receive a 3-day free introductory offer. If you do not cancel before the end of the introductory period, Apple will charge the subscription price shown at purchase.

5.4 Renewal, Cancellation, and Billing

Payment is charged to your Apple ID account at confirmation of purchase or after any eligible free trial. The subscription renews automatically each month unless canceled at least 24 hours before the end of the current period. You can manage or cancel the subscription in Apple ID subscription settings or at apps.apple.com/account/subscriptions.

5.5 Refunds

Apple handles App Store purchases and refunds. To request a refund, visit reportaproblem.apple.com or contact Apple Support. Dynsell cannot issue App Store refunds directly.

5.6 Price Changes

Subscription pricing may change. Apple handles required notices, consent flows, and subscription settings for App Store subscriptions.

6. Your Content

You retain ownership of videos, audio, captions, edits, and exports you create or process with CaptionAddr. You are responsible for having the rights and permissions needed to import, caption, edit, export, save, and share your content.

You agree not to use CaptionAddr to create, process, or distribute content that is unlawful, infringes third-party rights, violates privacy or publicity rights, or otherwise creates liability for you, Dynsell, Apple, or service providers.

8. Open-Source Components

CaptionAddr includes open-source components. Required notices are available at captionaddr.com/licenses/. Those licenses govern your rights to the applicable open-source components, and nothing in these Terms limits rights granted directly by those licenses.

9. Third-Party Services

CaptionAddr relies on Apple services for App Store distribution, purchases, subscriptions, refunds, and subscription management. It uses Firebase services for backend infrastructure, TikTok services for advertising measurement and attribution, and model delivery services as described in the Privacy Policy. The website is hosted on Netlify. Third-party services are governed by their own terms and policies.

10. Accuracy of Transcription

Speech transcription may be inaccurate or incomplete. Accuracy can vary based on audio quality, background noise, speech, language, accents, timing, and device conditions. You are responsible for reviewing and editing captions before publishing or relying on them.

11. No Warranty

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPTIONADDR IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT CAPTIONADDR WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR SUITABLE FOR ANY PARTICULAR USE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DYNSELL LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO CAPTIONADDR OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DYNSELL LLC'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO CAPTIONADDR OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO DYNSELL THROUGH CAPTIONADDR IN THE 12 MONTHS BEFORE THE CLAIM OR $50 USD.

13. Indemnity

You agree to defend, indemnify, and hold harmless Dynsell LLC and its officers, employees, contractors, agents, and service providers from claims, damages, liabilities, losses, costs, and expenses arising from your content, your use of CaptionAddr, your violation of these Terms, or your violation of law or third-party rights.

14. Termination

You may stop using CaptionAddr at any time. We may suspend or terminate access to CaptionAddr if you violate these Terms, create risk or liability, or if continued operation is not commercially or technically feasible. Sections that by their nature should survive termination will survive.

15. Apple-Specific Terms

These Terms are between you and Dynsell LLC, not Apple Inc. Dynsell is solely responsible for CaptionAddr and its content, subject to these Terms. Apple has no obligation to provide maintenance or support for CaptionAddr. If CaptionAddr fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as required by Apple's terms. To the maximum extent permitted by law, Apple has no other warranty obligation for CaptionAddr.

Apple is not responsible for claims relating to CaptionAddr or your use of it, including product liability claims, legal or regulatory claims, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific terms against you.

16. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles, except where applicable law requires otherwise.

We may update these Terms from time to time. When we update them, we will revise the "Last Updated" date. Continued use of CaptionAddr after updated Terms become effective means you accept the updated Terms.
