Terms for using CaptionAddr, its website and related services.

1. Agreement and eligibility

These Terms are between you and Dynsell LLC (“Dynsell,” “we,” or “us”), based in Bend, Oregon, United States. Apple is not a party to this agreement. They apply when you accept them in CaptionAddr or otherwise agree to use our services under them. Apple’s applicable App Store usage and purchase terms also apply to downloads and purchases through Apple. These Terms do not override Apple’s applicable usage rules.

You must be at least 13 and able to enter this agreement under the law that applies to you. If you are below the age of legal capacity, a parent or guardian must agree and supervise as required. If you act for an organization, you must have authority to bind it. The App Store’s content rating does not replace these requirements.

2. The service and its limits

CaptionAddr imports one video from Photos or, on Mac, from a file you select or drop, transcribes English speech locally with a bundled model, provides word editing and caption styling, and exports a movie with captions burned into the picture. Free supports videos up to 2 minutes; Pro extends that limit to 30 minutes. The current app does not provide cloud project sync, server-hosted media storage, standalone subtitle-file export, or a dedicated editor for individual caption start/end times.

Use a supported iPhone or iPad with iOS/iPadOS 17.0 or later and A12-class or newer Apple silicon. The Mac version being prepared for release requires macOS 14.0 or later. The App Store listing determines which versions and platforms are available. Actual speed and export capability depend on device, storage, media format and operating-system behavior. Online services may be needed for iCloud media retrieval, model recovery, purchases, restoration and entitlement verification.

Automatic captions can be incorrect or incomplete. You are responsible for reviewing the whole transcript, timing and exported video before using or publishing it. CaptionAddr is not a certified transcription service and does not guarantee accessibility, broadcast, evidentiary or other legal compliance for your output. Export can re-encode or change frame timing, dimensions and color; it is not a lossless or guaranteed HDR-preserving copy.

3. License and ownership

Subject to these Terms, we grant a limited, non-exclusive, non-transferable license to use CaptionAddr on Apple-branded devices you own or control, as allowed by Apple’s usage rules, including applicable Family Sharing or volume-purchase rights. The app is licensed, not sold. Dynsell and its licensors retain rights in the app, branding and website that are not expressly granted to you.

Open-source components have their own licenses, available on the notices page. Those licenses control your rights in those components. Nothing here restricts rights granted by those licenses or non-waivable rights under law.

4. Pro subscriptions and billing

CaptionAddr Pro is an optional auto-renewable monthly subscription sold through Apple. The app and Apple’s purchase sheet show the current local price, taxes as applicable, billing period, and any eligible introductory offer before you confirm. Offer eligibility is determined through Apple; no trial is guaranteed.

Apple charges the account used for purchase at confirmation or when an applicable trial ends, according to the displayed terms. The subscription renews automatically unless canceled. For a free or discounted trial you do not want to renew, cancel at least 24 hours before it ends. See the renewal date and cancellation options in Apple’s subscription settings.

Deleting CaptionAddr, resetting a project, or emailing support does not cancel the subscription. Cancellation and remaining access follow the purchase terms, Apple’s policies and applicable law. Prices may change subject to required notice and consent. Apple administers those purchase flows.

Use Restore Purchases in the app with the purchasing Apple Account if paid access is missing. Purchase verification can require connectivity. Expired, revoked or refunded purchases may no longer confer Pro access. If an active purchase is not recognized, contact support before purchasing again.

Request an Apple-billed refund at reportaproblem.apple.com. Apple assesses requests; we do not directly reverse Apple charges. This process does not limit your statutory remedies against the appropriate provider, including remedies for faulty digital content.

5. Your content and local storage

You retain whatever rights you hold in your videos, audio, edits and captions. Using the app does not transfer those rights to Dynsell, and no blanket license to upload or train on your media is granted. You must have the permissions needed to process, modify and share the content, including recording, copyright, privacy and publicity permissions.

Keep originals and save important exports outside the app. CaptionAddr works with one current local project. Reset, replacement, uninstall, storage failures and interruptions may remove or prevent recovery of app data. Recovery features are not a backup guarantee. Saving to Photos, exporting to a file destination or sharing creates copies governed by your chosen destination’s settings and terms. Removing the Mac app may leave local app data, and does not remove files saved elsewhere.

6. Responsible use

Do not use CaptionAddr unlawfully, infringe others’ rights, misrepresent captions as a verified quotation, interfere with infrastructure, or evade legitimate purchase/security checks. Do not reverse-engineer or redistribute proprietary app components except where law or the applicable license permits. These restrictions do not prevent lawful interoperability, research or rights that cannot be waived.

Comply with applicable export and sanctions rules. You represent that you are not in a U.S.-embargoed or designated terrorist-supporting country or on a U.S. prohibited/restricted-party list.

7. Third-party services

Apple supplies distribution, billing and platform features. Firebase supports security, entitlement reconciliation, aggregate workflow counts and diagnostics. Hugging Face may deliver fallback model files. Netlify hosts the website, and email providers deliver support messages. Their availability and terms can affect their parts of the workflow. External links are provided for relevant services and information. Review their terms before sharing content or personal information with them. We do not control their pages.

8. Support, changes and discontinuation

Contact CaptionAddr@gmail.com for help, complaints or accessibility needs. Response and resolution times depend on the issue; no guaranteed support service level is offered.

We may update the app or services to fix faults, maintain security or change features, subject to applicable law and paid-service obligations. We may restrict service access for material misuse or security threats, proportionately and with notice where practicable. Ending app use does not itself cancel an Apple subscription. If services are discontinued, applicable notice, refund and other consumer rights remain.

We may revise these Terms prospectively and identify the revision date. Material changes require appropriate notice and any agreement required by law; merely changing a web page does not retroactively alter earlier rights.

9. Warranties and responsibility

To the extent permitted by law, the app and website are provided “as is” and “as available,” without additional promises of uninterrupted availability, perfect recognition, error-free output or suitability for a particular purpose. This does not exclude mandatory quality, reasonable-care, security or other obligations, or remedies for breach of them.

To the extent lawful and enforceable, Dynsell is not liable for indirect, incidental, consequential or special losses, lost profits or business interruption. Where a monetary cap is permitted, our total liability arising from the service is limited to the greater of US $50 or the amount you paid for CaptionAddr in the 12 months before the event giving rise to the claim.

These limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury where liability cannot be limited, or any liability, statutory remedy or consumer right that cannot lawfully be excluded or capped. They do not change the burden of proof imposed by law. If a provision is unenforceable, it applies only to the extent permitted and the remaining provisions continue.

10. Apple-specific responsibilities

Dynsell, not Apple, is responsible for CaptionAddr and its support. Apple has no maintenance or support obligation. If the app fails to meet an applicable warranty, you may notify Apple and Apple will refund the app’s purchase price. To the fullest extent allowed by law, Apple has no other warranty obligation; Dynsell is responsible for other claims, losses, liabilities, damages, costs or expenses arising from that failure.

Dynsell is responsible for app-related product liability, legal/regulatory and consumer-protection claims, and investigating, defending, settling and discharging third-party intellectual-property claims concerning the app. Apple and its subsidiaries are third-party beneficiaries of these Terms. When you accept these Terms, Apple is deemed to accept the right to enforce them against you. Applicable third-party agreements and Apple usage rules must be observed.

11. Law and disputes

Oregon law governs to the extent permitted, without displacing mandatory protections of your place of residence. You retain any right to bring a claim in your local courts, complain to a regulator, or use a remedy provided by applicable law. These Terms do not impose mandatory arbitration or a class-action waiver. Please contact us first if you would like us to try to resolve a problem informally; doing so is not a condition on your statutory rights.
